I thought that two essays were particularly interesting: Methods of Proof In Western Medieval Law and the general overview essay which is titled Law In The Medieval World. They provide a very efficient introduction to this topic for general readers. One topic which comes up in many essays are the threefold sources that could generate new legal customs: (1) the academic scholarship of the universities, (2) the governmental acts of legislators and (3) the precedent-setting judgments of the courts. The author discusses the benefits and drawbacks of each source of law at some length. It would have been interesting to also read more about the order and degree to which various types of law (e.g. criminal law, constitutional law, administrative law and private law) developed in medieval Europe - some of the essays touch briefly on this subject but it is not discussed in detail. aucune critique | ajouter une critique
R.C. Van Caenegem is one of the few legal historians to have crossed national boundaries successfully. His knowledge of the various codes and customs of the European Continent in general and the Low Countries in particular enables him to bring a fresh eye to the English Common law.
